1. Privacy and (personal) data
The text below is important to read. Privacy is of great importance to Better Today. You as a user are the owner of your data. How we handle this safely is described in this document. It is a short explanation of our Privacy Statement.
The Digital Buddy is made available by Better Today BV. It comprises a digital tool, website and community with the objective of improving the quality of life of people with a chronic illness.
We respect your privacy
We believe in being transparent about how we deal with privacy and your data. We give you settings to determine whether and how your data may be used. We use data to help you understand your lifestyle in relation to chronic disease. We also use it to enable research into the combination of lifestyle, nutrition and chronic illness. This focuses on living a better life with a chronic illness.
Sharing data only after permission
If we share your data, we will only share it with your permission, we do so in such a way that no one knows it came from you. There will be in no way possible tell that the data is originated from you. If it is necessary for scientific research, for example, to know the year of your birth or where you live, we will ask you for your permission again.
2. Why we use information
To advise you
We use your personal information to provide you with the best possible experience and to help you with health and behavior.
To get smart
We use your information to be more accurate about your lifestyle and activities and to personalize information where necessary. This allows us to tailor functionality to your situation.
To protect you
We use information to promote the safety and security of our users, other parties and our products and services. For example, to authenticate users, protect against fraud and abuse, and enforce our terms and policies.
In case of a (possible) security breach Better Today will notify you immediately, including a brief description of the possible consequences and a recommendation for measures to mitigate the possible negative effects of the breach.
To keep in touch
We only use your contact information to stay in touch with you. When you contact us for help, we collect your name and phone number so we can respond and help you quickly. We never share this contact information with others without your explicit consent.
To do it bette
We use information to improve our products and services. For example, to provide user support, troubleshoot problems and protect against errors. And by conducting research and surveys and developing new features.
3. How we use information
Your data is yours
Better Today gives you information about your own lifestyle, motivating statements and tips, scientific information and stimulating comparisons of you with other users. With this information you increase your control over your life with a chronic illness.
We focus on health, lifestyle and behavior, not on illness. We think it is important to help other people do the same. To this end, we collect data on lifestyle: nutrition, behavior, what you do and how you feel. These are used to make a better life possible for people with a chronic illness. We do not store any data about your illness.
Your IP address
When you visit our website, we collect your IP address and may use it to ensure that the content is relevant to you. When you visit our site, we use cookies and other technologies to improve the website and our services.
Linked account information
We use the Eating Score of the WUR (Wageningen University & Research). We do not share any personal data with this partner. What they only know is that you are a user of the Digital Buddy, the reason why you can make use of their services free of charge. You can choose whether you want to use them and stop whenever you want.
4. You are in control
Your information is protected and not publicly visible. You can use our community to safely chat, email or share photos. In the protected community, your name may be visible to other users. Other information about you is not available to community users. The information from the community is never shared with third parties.
If you no longer wish to use the Digital Buddy, you can stop at any time. Of course we regret this. But you are in control. That is what we want to achieve as Better Today. So you decide. Do you want us to remove your data? Then delete the Digital Buddy from your phone and send an email with the subject “Delete my data” to info@bettertoday.nl and state your user name. Please realise that this requires lead time. Within 30 days, all of your information is deleted from our system.

Better Today (“we”, “us”) provides products and services that encourage people with chronic illnesses to take greater control of their own lives to improve their health and quality of life.
How nice that you use or want to use these products and services. We realise that privacy and security are precious commodities. We assume that you are the owner of your data.
Please be aware that when using our services and products, you explicitly agree with this Privacy Policy (“Privacy Policy”). Please read this Privacy Policy carefully.

5. What information we collect
When you use our Services, we collect the following types of information:
Account information
Some information is required to create an account on our Services, such as your name, email address and password. This is the only information you must provide to create an account with us.
Additional Information
To enhance your experience or enable certain features of the Digital Buddy, we may need additional information about your lifestyle and illness. You do not have to answer these questions. They help us to give you personalized information.
Questionnaires
If we ask you to participate in a survey, we will ask you again to agree that we share that information with the partner organization(s) indicated. We will show you specifically what information we collect, its purpose and who requested it. That is all we will do with it.
Linked information
To realize the purpose of the Digital Buddy for you, we offer the possibility to use apps of other organizations free of charge. For the use of these apps the privacy rules of these organizations apply. These organizations therefore ask you separately to read and accept these privacy rules. We can sometimes make the data from these apps visible in the Digital Buddy. We will ask you for your separate permission for this. We do this with the pedometer on your phone. For this we ask permission to link to Apple Health or Google Fit (depending on whether you have an Apple or Android phone) and to store this data and show it to you in the Digital Buddy. We link this to functionalities of the Digital Buddy such as the Tiny Habits, but we do not provide it to third parties.
6. How we collect data
Device information
Your device collects data for various statistics and insights, such as the Tiny Habits you use, the articles you read, and your state of mind. The data collected varies depending on the device you use. When your device is synced, data captured through your device is transferred from your device to our servers.
Usage information
When you use or interact with our Services, we receive certain usage or network activity information. This includes information about your interaction with the Services, such as when you view or search content, install applications or software, create your account, or log in.
We also collect information about the devices and computers you use to access the Services, including IP addresses, browser type, language, operating system, mobile device information (including device and application IDs), the referring web page, pages visited, location (subject to your consent) and cookie information.
Information We Receive From Third Parties
If you choose to link your account on our Services to your account on services provided by other organizations, we may receive information from that other organization. We use this information to fulfill the purpose of the Digital Buddy for you. For example, if you connect with Eating Score, we may record and show you the results of the analysis in ‘Measurement is knowledge’. You can stop sharing the other service’s information with us by removing our access to that other service.
7. How we use data
We use the information we collect in the following ways only,
To provide our Services
Using the information we collect, we are able to provide the Services to you and to fulfil our contract with the Terms and Conditions with you. For example, we need to use your information to provide you with your Better Today account; the community features of the Services; and to provide you with customer support.
For the community features, we may use your information to help you find and connect with other users and to enable other users to find and connect with you, for example by introducing them as friends in the community. Other users do not see or have access to this information.
Improving, personalizing and developing services
We use the information we collect to improve and personalize the Services and to develop new Services. For example, we use the information to troubleshoot and protect users from errors, perform data analysis and testing, conduct error investigations, and develop new features and services.
Communicating with You
We use your information as necessary to send you service notifications and respond to you when you contact us. We also use your information to communicate information about the Digital Buddy and to promote new features or surveys that we think you may be interested in.
Promoting Safety and Security
We use the information we collect to promote the safety and security of the Services, our users, and other parties. For example, we may use the information to authenticate users, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies. We use cookies and similar technologies for the purposes described above.
Security of Information
We work hard to keep your information secure. We use a combination of technical, administrative and physical controls to maintain the security of your information. This includes using Transport Layer Security (“TLS”) to encrypt many of our services. If you have any concerns or questions about security, please contact us.
8. How we store and retain data
We work on a European basis and only transfer information within Europe. We rely on legal bases to lawfully transfer personal data around the European Commission-approved standard contractual clauses, which require certain privacy and security protections under the European Union’s General Data Protection Regulation (“GDPR”).
Your data controller
Better Today is your data controller and provides the Services if you are resident in the EU, UK or Switzerland. For our contact information, please refer to the section “Who we are” and how to contact us.
We act in accordance with GDPR
To the extent that the data we collect is special category personal data covered by the GDPR, we ask for your explicit consent to process the data. We obtain this consent separately. You can use your account settings and tools to withdraw your consent at any time, including by stopping the use of a feature, removing our access to a third-party service, or deleting your data or your account.
Our legal bases for processing personal data
For personal data covered by the GDPR, we rely on various legal bases to process the data, including:
- Where you have given your consent, which you can withdraw at any time through your account settings and other tools;
- When the processing is necessary to perform a contract with you, such as the Terms of Service; and
- Our legitimate business interests, such as improving, personalizing and developing the Services, marketing new features or products that may be of interest, and promoting safety and security as described in the section “How we use information”.
How to exercise your legal rights
Under the GDPR, you have a general right to object to the use of your information for direct marketing purposes. Our statement of use describes your options to control how we and our partners use cookies and similar technologies. We do not use this for advertising purposes. You can delete your account at any time.
If you need more help regarding your rights, please contact our data protection officer at info@bettertoday.nl. You have the right to lodge a complaint with the local data protection authority or with the Dutch Data Protection Commission.
9. In which exceptional situations information is shared
We never use or sell the personal information of our users if you do not agree. We will not share your personal information except in the limited circumstances described below.
When you agree to share
You are in control of your data. You give your consent to share the information you record in the community with other participants in the community.
For all other information, you can control this in the privacy settings. In addition, we only share information with third parties that is not personally identifiable. The only exception to this is specific scientific research, for which the researcher then asks explicit permission.
We may share non-personal information that is aggregated or combined, which also means that it can never be traced back to an individual. We may publish such information, for example in Better Today newsletters, make it available to scientists and to partners. We always conclude an agreement with them in which the above is guaranteed.
We may pass on the completely anonymous information to partners who process the information for us, based on our instructions and in accordance with this policy. These partners provide us with services in the areas of data analysis, (scientific) research and surveys. The data they process is completely anonymous and cannot be traced back to a person.
For legal reasons to prevent damage
We may retain or disclose information about you to comply with a law, regulation, legal process or governmental request; to enforce legal rights or defend against legal claims; or to prevent illegal activity, fraud, abuse, violations of our terms or threats to the security of our Services or users.
Please note: Our policy is to notify you of legal proceedings seeking access to your information, such as court orders or subpoenas, unless we are prohibited from doing so by law. In cases where a court order specifies a non-disclosure period, we will provide delayed notice after the non-disclosure period has expired.
If we are involved in a merger, acquisition or asset sale, we will continue to take steps to protect the confidentiality of personal information and will notify affected users before transferring personal information to a new entity.
10. Your right to access and control your personal data
You are in control. We provide you with account settings and tools to access and control your personal data. We fully comply with the European directives of the GDPR and the translation in each of the countries in which we operate. You can exercise the legal rights relating to your data through and tools, as set out below.
Editing and deleting data
By logging into your account and using the account settings, you can change your personal data. For example, you can edit or delete the profile data you have provided and delete your account if you wish. By sending us an e-mail, you can gain insight into all your personal data that we have and have provided.
If you choose to delete your account, please note that most of your data will be deleted or anonymized within 30 days. We may also retain data for legal reasons or to prevent harm, including as described in the section entitled “How information is shared”.
Objecting to data use
We provide you with account settings and tools to control our data usage. For example, through your privacy settings you can limit how your data is shared; through your notification settings you can limit the notifications you receive from us.
Data Retention
We will retain your account information, such as the username, email address and password you provide, for as long as your account exists because we need it to manage your account. We will delete the data by return if it is no longer required by us.
No advertising
We do not use advertising services!
11. The Digital Buddy has been developed for adults
The Digital Buddy has been developed and is intended for adults.
Persons under 18 years of age who nevertheless wish to use the Digital Buddy must agree in writing with their parents or guardians and do so together with and under the full responsibility of their parents or guardians.
Persons under 18 years of age may not create accounts. If we learn that we have collected personal information from someone under 18 without parental consent, we will delete the information and delete the account as soon as possible. Parents who believe that their child has provided us with personal information without their written permission are asked to contact us to delete the information and account.
12. Changes to this policy
We will notify you of changes to our privacy policy via our user letter. If there are material changes, we will notify you at least one week prior to the change in this Policy so that you have an opportunity to review the revised Policy before deciding whether to continue using the Services. You may request previous versions of the Policy from us.
